1. Acceptance of Terms

By installing our WordPress plugin, creating an account, or using Bandwidth Saver ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you're using the Service on behalf of an organization, you're agreeing to these Terms on their behalf.

If you don't agree to these Terms, don't use the Service.

2. Service Description

Bandwidth Saver is an image content delivery network (CDN) for WordPress websites. The Service:

  • Caches images from your WordPress site on our global edge network
  • Serves cached images to your visitors from the nearest server location
  • Tracks bandwidth usage for billing purposes
  • Provides a usage dashboard within WordPress

2.1 What the Service Is

An image delivery optimization service. We cache and serve your existing images faster.

2.2 What the Service Is Not

  • Not an image hosting service — your images must exist on your origin server
  • Not an image editing or optimization service — we serve images as-is
  • Not a backup service — we cache images temporarily, not permanently
  • Not a general-purpose CDN — we only handle image files

3. Accounts

3.1 Registration

To use the Service, you must:

  • Provide a valid email address
  • Register a domain that you own or have authority to manage
  • Be at least 16 years old (or the age of majority in your jurisdiction)

3.2 Account Security

You're responsible for:

  • Maintaining the security of your WordPress installation
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access

3.3 One Account Per Domain

Each domain may only be registered to one Bandwidth Saver account. Attempting to register the same domain multiple times to circumvent usage limits is prohibited.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not use Bandwidth Saver to serve:

4.1 Prohibited Content

  • Illegal content — Content that violates any applicable law
  • Malware — Files designed to harm users' devices or data
  • Infringing content — Images you don't have rights to distribute
  • CSAM — Child sexual abuse material (zero tolerance, immediate law enforcement referral)
  • Non-consensual intimate imagery — "Revenge porn" or similar

4.2 Prohibited Behaviors

  • Abuse of free tier — Creating multiple accounts to exceed limits
  • Hotlinking from non-registered domains — Using our CDN URLs on sites you haven't registered
  • Automated abuse — Bots or scripts designed to abuse the Service
  • Reverse engineering — Attempting to reverse engineer our systems
  • Reselling — Reselling the Service without authorization

4.3 Enforcement

We reserve the right to:

  • Remove content that violates these Terms
  • Suspend or terminate accounts for violations
  • Report illegal content to appropriate authorities
  • Cooperate with law enforcement investigations

5. Your Content

5.1 Ownership

You retain all rights to your images. We don't claim ownership of any content you serve through our CDN.

5.2 License to Us

By using the Service, you grant us a limited license to:

  • Fetch images from your origin server
  • Cache copies of those images on our network
  • Serve those images to your website's visitors
  • Create optimized versions (e.g., WebP) for better delivery

This license exists solely to provide the Service and terminates when you stop using the Service.

5.3 Your Responsibility

You're solely responsible for:

  • Ensuring you have rights to distribute the images
  • The content of images served through our CDN
  • Compliance with applicable laws in your jurisdiction

6. Service Levels

6.1 Free Tier

The free tier is provided "as is" with:

  • No uptime guarantee or SLA
  • 100 GB bandwidth per month
  • Best-effort support

When you exceed the free tier limit, images will be served directly from your origin server until the next billing cycle. Your site won't break — it just won't benefit from CDN acceleration.

6.2 Paid Plans

Paid plans include:

  • Higher bandwidth allocations
  • Priority support
  • 99.9% uptime target (not a guarantee)

6.3 No Absolute Guarantees

While we strive for high availability, we cannot guarantee:

  • 100% uptime
  • Specific performance levels
  • Uninterrupted service during maintenance

7. Pricing & Billing

7.1 Free Tier

The free tier (100 GB/month) is genuinely free with no credit card required. We reserve the right to modify free tier limits with 30 days notice.

7.2 Paid Plans

  • Prices are listed in USD
  • Billing is monthly via Stripe
  • You can cancel anytime — access continues until the end of your billing period
  • No refunds for partial months

7.3 Price Changes

We may change prices with 30 days email notice. Price changes take effect at your next billing cycle. If you don't agree, you can cancel before the new price takes effect.

7.4 Overages

We don't charge overage fees. If you exceed your plan's bandwidth:

  • Images serve from your origin server instead of our CDN
  • You can upgrade your plan anytime for immediate additional bandwidth

8. Termination

8.1 By You

You can stop using the Service at any time by:

  • Deactivating the WordPress plugin
  • Deleting your account through the plugin settings
  • Canceling any paid subscription

8.2 By Us

We may suspend or terminate your account:

  • Immediately for serious violations (illegal content, abuse)
  • With 7 days notice for other Terms violations
  • With 30 days notice if we discontinue the Service

8.3 Effect of Termination

Upon termination:

  • Your images will load from your origin server (no service interruption)
  • Cached images will be purged from our network
  • Your account data will be deleted per our Privacy Policy
  • Any prepaid fees are non-refundable (except if we terminate without cause)

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the security of the Service
  • Any warranties arising from course of dealing or usage of trade

Your origin server remains the authoritative source of your images. If our Service experiences issues, images will load from your server. We're a performance optimization, not a critical dependency.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not liable for any loss of profits, data, use, goodwill, or other intangible losses
  • Our total liability is limited to the amount you paid us in the 12 months before the claim (or $100 for free tier users)

These limitations apply regardless of the theory of liability (contract, tort, or otherwise).

Some jurisdictions don't allow these limitations, so they may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Content you serve through our CDN
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Changes to Terms

We may modify these Terms at any time. When we make changes:

  • We'll update the "Last updated" date
  • For material changes, we'll provide notice via email
  • Changes take effect 30 days after notice (or immediately for legally required changes)

Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. General Provisions

13.1 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.

13.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

13.4 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

13.5 No Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right or provision.

13.6 Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor in interest.
